    My Funding Machine, LLC ("Funding Machine," "Company," "we," "our," or "us") respects the privacy of our customers, website visitors, and users of our software-as-a-service platform located at www.myfundingmachine.com (the "Site" and collectively with related services, the "Services"). This Privacy Policy ("Policy") describes the types of information we collect, how we use and share it, your rights regarding that information, and the obligations of both Funding Machine and our clients.

    By accessing or using the Services, you acknowledge that you have read, understood, and agreed to this Policy. If you do not agree with the terms of this Policy, you must not use the Services.

    1. Information We Collect

    1.1 Information You Provide to Us

    When you sign up for or use the Services, we may collect:

    • Name, email address, phone number, and billing details.
    • Login credentials (username and password).
    • Company name, business logo, and other branding elements you choose to upload.
    • Customer support communications, including emails, chats, or submitted requests.
    • Last four digits of payment cards and a token via our payment processor; we do not store full card numbers.
    • Usage and activity logs.

    1.2 Information We Collect Automatically

    We may automatically collect information when you visit our Site or use the Services, including:

    • Device and browser information.
    • IP address and approximate location.
    • Cookies and similar tracking technologies (see Section 3 for details).

    1.3 Client-Collected Data (End-Users)

    Our clients (Funding Machine owners) may, through their use of the Services, collect sensitive personal information from their customers or applicants, including but not limited to date of birth, Social Security Number, Employer Identification Number, financial details, or credit information.

    Funding Machine does not control, access, or determine the means or purposes of such information. We act solely as a data processor with respect to this data, while our clients act as the data controllers and are fully responsible for providing their own privacy notices, obtaining appropriate consents, and complying with all applicable laws and regulations, including but not limited to the Gramm-Leach-Bliley Act ("GLBA"), the Fair Credit Reporting Act ("FCRA"), and any applicable state laws and bonding/licensing requirements.

    2. How We Use Information

    We use the information we collect to:

    • Create, maintain, and manage user accounts.
    • Process payments, invoices, and subscriptions.
    • Provide customer support and respond to inquiries.
    • Send notices about your account, the Services, or updates to this Policy.
    • Conduct internal research, analytics, and product improvement.
    • Send marketing or promotional communications, where permitted by law and with your consent where required.
    • Authenticate users and detect fraud or security threats.
    • Comply with applicable laws and enforce our Terms of Service.

    • Advertising Pixels: We use the Meta (Facebook) Pixel to measure the effectiveness of our advertising campaigns.
    • CRM Tracking: GoHighLevel and Zoho CRM may track form submissions and funnel interactions.

    3.2 Your Choices

    You may control cookies through your browser settings. Most browsers allow you to refuse, delete, or be notified of cookies. Please note that disabling cookies may affect the functionality of certain parts of our Services.

    You may also opt out of specific third-party tracking:

    Do Not Track ("DNT") signals: Our Site does not currently respond to DNT browser signals. We will update this Policy if that practice changes.

    4. How We Share Information

    We do not sell, rent, or trade your personal information.

    We may share information in the following circumstances:

    • Vendors and Service Providers: We share data with third-party vendors who assist in providing the Services, including: Payment processing: Stripe, NMI, Finix; Hosting/infrastructure/CDN: Vercel, Cloudflare; CRM/automation: GoHighLevel, Zoho CRM; Analytics and advertising: Google Analytics, Meta Pixel, Microsoft Clarity; Communications: Twilio (SMS/voice), Mailgun (email). We enter into data processing agreements with these vendors to ensure appropriate data protections.
    • Legal Compliance: When required by law, regulation, or legal process, or to protect the rights, property, or safety of My Funding Machine, our users, or others.
    • Business Transfers: In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.

    5. SMS and Telephone Communications (TCPA)

    If you or your clients use our built-in calling and SMS features, the following applies:

    • Consent Required: You and your clients are responsible for obtaining express written consent from any individual prior to sending automated text messages or placing calls using our platform, as required by the Telephone Consumer Protection Act ("TCPA") and applicable state telemarketing laws.
    • Opt-Out Compliance: You must honor opt-out requests promptly. Our platform supports opt-out management tools, but compliance remains your responsibility as the data controller.
    • Do Not Call Registry: You and your clients are responsible for maintaining compliance with the National Do Not Call Registry and any applicable state do-not-call rules.

    My Funding Machine provides the technological infrastructure for communications but is not liable for how clients use those features. Each client is solely responsible for their own TCPA and telemarketing compliance.

    6. Data Location and Retention

    Data is primarily stored in U.S.-based data centers. Subprocessors (including GoHighLevel, Zoho CRM, Stripe, NMI, Finix, Vercel, Cloudflare, Twilio, and Mailgun) may process or store data in U.S. regions or other regions per their own policies, though we endeavor to keep data in the U.S. where feasible.

    We retain account information for as long as an account is active in order to provide the Services and as necessary to comply with our legal obligations. Upon account termination, we will retain customer data for up to 30 days, after which it will be deleted or anonymized, unless a longer retention period is required by law. Certain transaction and billing records may be retained for up to seven (7) years to comply with tax, audit, and accounting obligations.

    7. Security

    We implement industry-standard safeguards designed to protect the confidentiality, integrity, and security of your information, including:

    • Encryption in transit (TLS) and at rest (AES-256 or equivalent).
    • Role-based access controls and least-privilege access for staff and administrators.
    • Strong password hashing (bcrypt or equivalent).
    • Firewalls and DDoS protection via Cloudflare.
    • Regular backups and disaster recovery procedures.
    • Vendor due diligence and Data Processing Agreements (DPAs) with subprocessors.
    • Logging, monitoring, and alerting for security events.
    • Secure software development practices, including code reviews and dependency scanning.
    • Incident response procedures with notifications as required by law.

    Multi-factor authentication is not currently required for client accounts, but we strongly recommend enabling it where available. While we use commercially reasonable efforts to safeguard data, no system can be guaranteed to be 100% secure. You acknowledge that transmission and storage of information is at your own risk.

    8. Client Responsibilities

    Clients of My Funding Machine are solely responsible for:

    • Determining the categories of personal information they collect from their own customers.
    • Drafting, publishing, and maintaining their own privacy policies and required disclosures.
    • Obtaining all legally required consents from end-users before collecting personal, financial, or credit-related information.
    • Complying with all federal, state, and local laws and regulations governing financial data, credit reporting, telemarketing, and consumer information, including GLBA, FCRA, TCPA, CAN-SPAM, and applicable state licensing laws.
    • Ensuring they have a permissible purpose under the FCRA before accessing any consumer report information through our integrated third-party providers.

    My Funding Machine maintains a surety bond in the State of Utah, but compliance with other state-specific licensing, bonding, or regulatory requirements is the sole duty of each Funding Machine owner.

    9. Legal Compliance

    • GLBA: We are not a financial institution; clients who are financial institutions must independently comply with GLBA Safeguards Rules. We act as a service provider where applicable.
    • FCRA: My Funding Machine is not a consumer reporting agency and does not itself provide consumer reports. Certain Services may allow clients to access consumer report information through integrated third-party providers. Clients are solely responsible for ensuring they have a permissible purpose, providing required notices and disclosures, and otherwise complying with the FCRA.
    • Children's Privacy: We do not knowingly collect personal information from children under the age of 13. The Services are not directed to minors. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at info@myfundingmachine.com.

    10. Your Rights — California Residents (CCPA/CPRA)

    If you are a California resident, the California Consumer Privacy Act ("CCPA"), as amended by the California Privacy Rights Act ("CPRA"), grants you specific rights regarding your personal information.

    10.1 Categories of Personal Information We Collect

    We collect the following categories of personal information as defined by the CCPA:

    • Identifiers: Name, email address, IP address, and account username.
    • Commercial Information: Subscription and billing records.
    • Internet or Network Activity: Browsing behavior on our Site via cookies and analytics tools.

    • Right to Limit Use of Sensitive Personal Information: To the extent we process sensitive personal information as defined by the CPRA, you have the right to limit its use and disclosure to what is necessary to provide the Services.
    • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

    We will respond to verifiable consumer requests within 45 days of receipt, with the option to extend by an additional 45 days when reasonably necessary. We may need to verify your identity before processing your request.

    Authorized Agents: You may designate an authorized agent to submit a request on your behalf. We may require written proof of authorization and verification of your identity.

    11. Your Rights — Other U.S. State Privacy Laws

    Several U.S. states have enacted consumer privacy laws that may provide rights similar to those described above. If you are a resident of Colorado, Connecticut, Virginia, Texas, or another state with applicable privacy legislation, you may have the right to access, correct, delete, or obtain a portable copy of your personal information, and to opt out of certain processing activities.
